Senate Blocks Clarity Act as Crypto Market Structure Bill Falls Short of 60 Votes

Cloture on the motion to proceed failed 49 to 50 on Tuesday. The House had passed the same bill 294 to 134 in July 2025. Forty eight days remain until Election Day.

What the Senate did on Tuesday

The Senate on Tuesday failed to advance the Digital Asset Market Clarity Act, the high profile cryptocurrency market structure bill known as the Clarity Act (New York Times, September 15, 2026; Reuters, September 15, 2026). Cloture on the motion to proceed to H.R. 3633 needed 60 votes under the chamber's usual threshold for most contested legislation. The roll call printed 49 yeas and 50 nays, with one senator not voting, eleven votes short of the mark (The Defiant citing Senate Daily Press floor log, September 15, 2026; BloFin Academy summarizing Senate roll call 234, September 16, 2026).

Every yea came from a Republican. No Democrat and neither of the two independents who caucus with Democrats voted to take the bill up. Four Republicans joined the opposition: Susan Collins of Maine, Josh Hawley of Missouri, Jerry Moran of Kansas, and Thom Tillis of North Carolina (Reuters, September 15, 2026; The Defiant, September 15, 2026). Tillis switched to no in a procedural move that preserves his ability to seek reconsideration later (Reuters, September 15, 2026).

How far the bill had already traveled

The House passed H.R. 3633 on July 17, 2025, by 294 yeas to 134 nays on Roll Call 199, with 78 Democrats joining every Republican present in the aye column (Congressional Record; House Democratic Cloakroom vote summary, July 17, 2025; Voteview, UCLA). That bipartisan House margin is the first receipt on the timeline. The Senate Banking Committee later ordered a substitute reported favorably in May 2026, and Republicans released what they called a final text on the eve of this week's vote in a last effort to address banking industry and ethics concerns (Axios, September 15, 2026; Reuters, September 15, 2026).

The bill would have divided digital asset oversight between the Securities and Exchange Commission and the Commodity Futures Trading Commission, clarifying which tokens fall under securities law and which under commodities law (New York Times, September 15, 2026; Just the News, September 15, 2026). Industry groups had spent more than $100 million on political efforts around the fight, according to the Times account of the Tuesday defeat (New York Times, September 15, 2026). Polymarket cut the implied odds that the bill becomes law this year from about 29.5 percent on Monday to about 6.5 percent after the roll call (The Defiant, September 15, 2026).

Why Democrats and four Republicans said no

Democratic opposition centered on ethics language tied to President Donald Trump's crypto holdings. The Times reported that Trump generated $1.4 billion from a network of crypto businesses last year and that Democrats wanted stronger barriers against public officials using crypto to make money while agencies write the rules (New York Times, September 15, 2026). Senator Mark Warner of Virginia said after the vote that a bill could not move forward that would allow the president to profit personally from the industry his administration regulates (The Block, September 15, 2026). Senator Ruben Gallego of Arizona said he would not support legislation that, in his words, gives the president time to crime (New York Times, September 15, 2026).

Named Democrats who had been active in negotiations and still voted no included Kirsten Gillibrand of New York, Catherine Cortez Masto of Nevada, Cory Booker of New Jersey, Angela Alsobrooks of Maryland, and Raphael Warnock of Georgia, among others (Benzinga summarizing floor reporting, September 15, 2026; The Block, September 15, 2026). On the Republican side, Collins, Hawley, Moran, and Tillis denied the majority a clean party line, leaving the chamber ten votes short of 60 even if every Democrat had stayed home (Reuters, September 15, 2026).

What the midterm calendar does to the bill

Congress is set to leave Washington this month for the final stretch before the November 3 midterms (Reuters, September 15, 2026; Alston and Bird look ahead, September 14, 2026). That calendar is the second receipt. A market structure statute that needs 60 Senate votes and a House concurrence path does not have many floor days left in this Congress. Axios and CoinDesk both framed the regulatory work as shifting back toward the SEC and CFTC for now (Axios, September 15, 2026; Benzinga citing CoinDesk, September 15, 2026).

A failed cloture vote does not move a Cook rating by itself. It does freeze one major industry priority until a later Congress can rebuild a 60 vote coalition.

What is settled and what remains open

Settled on Tuesday's desk: H.R. 3633 did not clear cloture, the tally was 49 to 50 with one not voting, the House had already passed the bill 294 to 134 in July 2025, and no Democrat voted to proceed (New York Times, September 15, 2026; Reuters, September 15, 2026; Congressional Record, July 17, 2025). Settled on the money trail cited in the Times: more than $100 million in industry political spending around the fight, and a reported $1.4 billion in Trump linked crypto business proceeds last year (New York Times, September 15, 2026). Still open: whether Tillis or leadership brings a motion to reconsider before recess, whether a post election Senate of different composition revisits market structure, and how the SEC and CFTC write rules without the statute. Still open on the political board: whether crypto linked donors keep writing checks into Senate and House races that US Political Rank already tracks on one ruler. Score the roll call. Score the House margin from 2025. Leave the next Congress to the canvass that finishes in forty eight days.
