The CLARITY Act Reaches the Senate Floor. Passing It Takes 60 Votes and Seven Democrats.

The digital asset market structure bill that cleared the House a year ago is expected to reach the Senate floor as soon as this week. It passed one chamber with room to spare. The other chamber runs on a number the House does not have to meet.

What is on the floor this week

The Digital Asset Market Clarity Act, the crypto market structure bill known as the CLARITY Act, is expected to reach the Senate floor as soon as the week of July 20, 2026, according to its advocates (CoinDesk, July 9, 2026; CryptoSlate, 2026). It arrives with a long paper trail. The House passed the measure, H.R. 3633, on July 17, 2025, by a bipartisan vote of 294 to 134 (U.S. House Clerk, Roll Call 199, July 17, 2025; Congress.gov, H.R. 3633, 2026). The Senate Banking Committee then advanced its own version on May 14, 2026, by 15 to 9, with all 13 Republicans joined by two Democrats (Latham and Watkins, US Crypto Policy Tracker, 2026; ABA Banking Journal, May 2026).

On June 1, 2026, the bill was placed on the Senate Legislative Calendar under General Orders as Calendar No. 423, which made it formally eligible for full floor consideration (Latham and Watkins, US Crypto Policy Tracker, 2026). A Senate Banking hearing on July 17, 2026, set the terms of the debate ahead of a floor vote (crypto.news, July 17, 2026). The bill would create a federal framework sorting digital assets between the Securities and Exchange Commission and the Commodity Futures Trading Commission, and it would place most digital commodity trading under the CFTC (Congress.gov, H.R. 3633, 2026).

Why 60 is the only number that matters

The House passed the CLARITY Act with a simple majority. The Senate cannot. To end debate and move to a final vote, the bill needs to clear cloture, which takes 60 votes (U.S. Senate, Cloture, 2026). Republicans hold 53 seats, so a united Republican caucus is still seven votes short of 60. At least seven Democrats or independents would have to join for the bill to advance (CryptoSlate, 2026).

That gap is the whole story. It is the same wall that decides most major legislation in the modern Senate, where the routine 60 vote requirement, not the 51 vote majority, sets the real price of passage. US Political Rank tracks how central that threshold has become in its report on the rise of the 60 vote Senate, and it ranks the members most likely to reach across the aisle in senators by bipartisanship. The seven votes the CLARITY Act needs will come, if they come, from the names near the top of that second list.

The three knots still tied

Three disputes have kept those Democratic votes uncommitted. The first is jurisdiction. Senators on the Agriculture Committee, which oversees commodities and the CFTC, want assurance that the framework does not shortchange the commodity regulator or its funding (Yahoo Finance, 2026). The second is enforcement. Parts of the law enforcement community have warned that a legal shield for developers of decentralized finance software could complicate cases against bad actors (CoinDesk, June 22, 2026). The third is stablecoin yield, the question of whether and how holders can earn interest, a fight that touches banks as much as crypto firms (Yahoo Finance, 2026).

Layered on top is an ethics provision. The two Democrats who voted to advance the Banking Committee's version said their floor votes were not guaranteed without stronger language addressing government officials' financial ties to the crypto industry (Latham and Watkins, US Crypto Policy Tracker, 2026). Each of these is solvable. None is solved yet, and any one of them can keep the count under 60.

The precedent sitting right next to it

There is a reason the crypto industry treats this vote as winnable rather than hopeless. A companion bill already cleared the same 60 vote wall. The GENIUS Act, which set the first federal rules for payment stablecoins, passed the Senate 68 to 30 on June 17, 2025, passed the House 308 to 122 on July 17, 2025, and was signed into law on July 18, 2025 (Congress.gov, S. 1582 GENIUS Act, 2025; Latham and Watkins, US Crypto Policy Tracker, 2026).

Sixty eight is eight votes past cloture. That vote proved a crypto bill can attract a durable bipartisan coalition in the Senate, not just a party line majority. The CLARITY Act is a harder bill, because market structure reaches deeper into who regulates what than stablecoins did. But the honest read of the recent record is that the Senate has already shown it can get to 60 on this subject once. The question this week is whether it can do it twice on a tougher bill.

What to watch

Three markers will tell the story. First, timing: whether Majority leadership actually calls the bill up this week or lets it wait while the negotiations continue. Second, the count: whether seven Democrats commit publicly, and which version they commit to, because the Banking Committee text and the Agriculture Committee's concerns have not been fully merged. Third, the House: even a Senate that passes its version would then have to reconcile it with the House bill from July 2025 before anything reaches the president's desk (Congress.gov, H.R. 3633, 2026).

The number to keep in front of every headline is 60. The House moved this bill a year ago on a majority vote. In the Senate, a majority is not enough, and the difference between 53 and 60 is exactly seven votes that no one has yet delivered.
